A friend was arrested for immigration violations after overstaying her J1 student visa. What are her options?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
I would have to talk to her to review her credentials, experience, country she is from, etc. If she is an overstay most options will require her to apply and go home to get a new visa. If she wants to consult have her call to set up an appointment or consultation.

No. You have to get an i-20 (you'll need to show money for that), return to your country, make an apt with the US consulate and apply for a student visa. It is not possible to change your status if you came here with the waiver program.

Can I get a green card if my wife is a US citizen and I originally entered the US legally?

Since you entered with lawful inspection, and are now married to a US citizen, then you can adjust your status. You'll need to provide the proof of lawful entry by presenting your stamped passport.
