A U.S. citizen may apply for a fiance to get a K-1 visa for the purpose of entering the U.S. to become married within the statutory time. After becoming married, the couple may complete the steps for "adjustment of status" so that the wife may become a Lawful Permanent Resident (get a "Green Card"). Alternatively, he may marry aboard and then proceed with consular processing for his wife in the Immediate Relative visa category. There are advantages and disadvantages to each approach, and it would be wise to consult with an immigration attorney who, after learning all of the relevant details about the couple, could advise about eligibilities, options and strategies. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

My recommendation is that you talk with an attorney qualified and competent to advise you. Not really sure what your field of employment is, but you may be eligible to qualify for a visa under NAFTA and potentially other nonimmigrant visas. Yes, the immigrant option in the EB3 category sounds great but it ain't going to keep you in the US while you wait for a visa number to become available. Rather than waste your time and your money chasing after solution that may not be there, talk to someone who is licensed and certified to give you a realistic assessment of the options available to you. Be careful because there are plenty of us out here who will promise you the world and then disappear once we have your cash. There are decent attorneys out there, look them up and we are out there.

It is impermissible for someone to enter the U.S. on a student visa while intending to promptly become married and apply to remain in the U.S. permanently. Misuse of a visa in that way can have very harsh consequences. It would be wise to consult with an immigration attorney who, after learning all of the relevant information about your fiance and your/his goals, could advise about immigration eligibilities, options and strategies.
