Yes. You are eligible to apply for adjustment of status (permanent green card) if you entered the country legally and are married to a US citizen. However, if you apply for adjustment of status within 30-60 days of your arrival, immigration may accuse you of visa fraud for having the intent to remain in the US permanently when you arrived. So, you should be prepared to explain to them that you did not have that intent until after you arrived in the US.

Because you are now a USC, the cases should be automatically upgraded. That does mean that technically you are supposed to file an I-130 for your child as well, because immediate relatives can't be on the same petition. You will need to file an I-130 for your daughter and once it is with the NVC, you will want to upgrade your wife's petition. Let the NVC know that you have two family cases and one is for an infant so you can request that the files are matched and sent to the consulate for processing together.

As the company sent a check to the lawyer, the $2400 appears to be the property of the bankrupt company and not you.
