Could this be a felony expungement and cause of deportation?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
It is wise to have a competent and experienced immigration attorney to carefully review the criminal court records before filing. A domestic battery may be a reason to deport a greencard holder.

Yes. You can file without a valid passport. In fact, it is more important that you have the passport that you used when you last entered the country then to have a valid passport without any stamps.

Can I apply for citizenship even though I am separated from my husband?

Not after 5 years of residency. However, if you received your green card through marriage to your U.S. Citizen husband and tried to become a citizen after 3 years, your separation could cause a problem. However, if you wait for 5 years before applying for citizenship, your separation or, even divorce, should not be a problem.
