Can my husband become a green card holder after being deported?

Answered by attorney Carlos E. Sandoval
Immigration lawyer at Carlos E. Sandoval, P.A.
It possible for him to get his residency, but most probably he will have to request one or more waivers. First, he needs a waiver for the deportation7n and if he was here illegally over 6 months he will also need a waiver for the illegal presence. Based on what you mentioned about the health condition of your child it seems that you have a good case to show the hardship necessary to get the waivers approved.

Got assylum granted 2 years ago but did not apply for permanent residency

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
An individual granted asylum cannot apply for adjustment of status through form I-485 until one year has passed since the asylum was given. There is no deadline for application after that. Options to return after illegal reentry charge

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
If you marry him you would need to file for his 601 waiver and show extreme hardship to get approved. It's possible but it will be a struggle. If you were married and had a child together the chances would be higher. Any counsel who takes your case would need to file a waiver for the crimes and one for the illegal entry.
