They may or may not "investigate." There is a good chance it will be an issue when you have an interview.

How long will an I130 be approved?

I-130's for siblings take a long time because the quota is so long. It is a low priority item for the immigration service. You can call the 1-800 number on the receipt to inquire, but generally, 2-5 years is not unusual.

Can an international student invest in a business?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
An investment in an enterprise in the US without working in it is not considered unauthorized employment. If you are not there, but others manage the car dealership and you only obtain dividends and not regular compensation checks, you could continue to maintain your F-1 status. The difficulty may be if you do something more and you appear to be more involved than just as an investor.  Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
