Yes, you will be in an illegal immigrant if you overstay. You will not accrue unlawful presence until you reach the age of 18, but that only makes you subject to bars to admission. You will be illegal and subject to removal/deportation if you overstay. You should schedule a consultation with an attorney to see if you have any options to extend your stay or change to a long-term status.

I-130's for siblings take a long time because the quota is so long. It is a low priority item for the immigration service. You can call the 1-800 number on the receipt to inquire, but generally, 2-5 years is not unusual.
