I am unemployed and would like to apply for us citizen, will this affect my application?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
Being unemployed is not grounds for denial of your naturalization application. I would be concerned about that your first application was denied to lack of good moral character. The decision should state what you did or what was the bases for such a determination. A lack of good moral character can be a result of actions, other than criminal matters. Examples of things that could be found to be a lack of good moral character include: failure of males between the ages of 18 and 26 to register for selection service; failure to file tax returns, and failure to pay child support.

I recently got married and my husband entered the country on an F-1 Education Visa in January 2010. We are going to be submitting our INS paperwork

Answered by attorney Doreen A. Emenike
Immigration lawyer at Law Offices of Doreen A Emenike
It is always a good idea to continue with his schooling so that his F-1 visa remains valid until you are certain that you have properly filed his green card application and have a receipt as proof that it has been received by the USCIS. This applies to all types of visas too. It is always best to maintain your current visa until you actually make the transfer, just in case something goes wrong. For legal advice regarding your case you should consult an attorney as this is information of a general nature and not intended to be legal advice.
