Is travelling while applying for a change of status ok?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
The change of status application is considered abandoned once the applicant leaves the US while the application is pending. You may consider not to file change of status for your wife. She can leave the US as planned, wait outside of the US for your H1 approval. Once approved, she can apply for H4 visa in her home country and come in on her H4 visa. You need to be aware that if your H1 is subject to the quota, your H1 status would not be effective until October 1, 2013. Since you would not have H1 status until then, your wife cannot apply for H4 visa until sometime near October 1, 2013.
