Your brother may petition for you if he is at least 21 years of age. However, the new petition will not have the same priority date as your mother's petition for you. If you are still unmarried, there is no advantage to the F4 category because the wait period would be about the same even if you were allowed to keep the priority date you would have to wait an additional 2 years in either category. On the other hand, if you were to marry a US citizen then you could apply for your residency immediately upon payment of the $1000 penalty.
