If they entered the US legally but overstayed, its easy for your mother but its hard for your brother. For your mother you can file I-130 and she can file I-485 to adjust status. For your brother, due to the long wait for the visa number, he will not be eligible for immigration until at least 12 years later. he also must maintain status(he already out of status). Please consult with immigration lawyer for advise.

Any person can provide an affidavit, but affidavits from non-family members are preferred because USCIS believes they are more credible. The more affidavits you get the better it is for your case, but you should submit at least 2-3 affidavits.

When you say sponsor it means financial sponsor. If your question on whether your uncle can petition for your mom and you at the same time, the answer is no. Your uncle would have to petition for your mother and once your mother has her green card, she can then petition for you. Ironically enough, if your uncle is a green card holder, you will receive your green card when your mother does!
