Is it possible for B2 visa holder to adjust a status when sponsored by employer?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
If in the US in a legal status, like B1/B2, and assuming an I-140 petition has been approved and a visa number is available, one can adjust status without leaving the US.  If the company has not yet started the immgrant visa process, it may take longer than the remaining 5 months in B2 status to accomplish, in which case you would either need to apply for an extension of B2 status, or leave at the end of the five months and process the immigrant visa outside the US once it is approved and a visa number is available.

Should I file for Green Card if parents were denied B2 visa a couple of times?

Answered by attorney Jennifer Maude Oltarsh
Immigration lawyer at Oltarsh & Associates, P.C.
Yes it is odd, but the criteria is different. The Consulate was not convinced that they will return home. You can file for their residence.

Resident alien/non resident status

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
An individual who enters the US on an immigration visa is a permanent resident upon entry. The stamp on the passport given by CBP at the airport is the confirmation of resident status. Therefore, although I do not know tax law, I believe that you should be filling out “resident alien”  as you are a permanent resident regardless of whether you have yet to receive the physical card.
