Answered by attorney Violet Ikeanyi Nwokoye (Unclaimed Profile)

Depending on the state you choose to visit in the United States, the answer might be different. State of Texas require a six months residency to qualify to file for divorce here. If your visa does not allow for that period of time, then it will be a problem.

What are our options if my boyfriend and I want to get married but he’s from Honduras and only has his passport?

Immigration lawyer at Quan Law Group, PLLC
If he entered with a visa and overstayed, you can adjust his status to permanent resident through marriage. If not, he will have to obtain a provisional waiver and then Consular Process in Honduras. This is assuming that there are no other grounds of inadmissibility.

Does she have to leave the country to get her green card?

Answered by attorney Eric Arden Fisher (Unclaimed Profile)
Immigration lawyer at The Law Office of Eric A. Fisher, LLC
If she last entered the US without inspection, she will need to get her immigrant visa at the US Consul abroad even if your I-130 is approved. There is a recent opinion that explains that if she is able to get advance parole and can re-enter with that, she may be able to adjust here, but she really should speak with an immigration attorney.
