If your nephew has a green card, he will have to wait until he is 18 and had the green card for 5 years (whichever is later), unless you legally adopt him before he turns 16, in which case it is a different procedure that can be started any time. If you nephew does not have a green card, you can obtain it for him either through adopting him or through a procedure under Special Immigrant Juvenile status. Both processes are legally complex and should be handled by a professional.

If your mother's parents became US citizens prior to your mother turning the age of 18, and your mother was a permanent resident at the time, she would be considered a citizen and could apply for either a US passport or U.S.C.I.S. recognition through an N-600 application for certificate of citizenship. If that did not occur, either you or your father could petition for her permanent residence. As the immediate relative of a US citizen, the process would be fairly quick and relatively easy.
