If you file an I-485 and they leave without an advance parole, they will be deemed to have abandoned their application for residence.

Should my stepdaughter apply for tourist visa first then once here I can mail off the I130 as her sponsor?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
You could do that. However, based on her age, she will have a significant backlog. The I-130 will not allow her to stay while it is pending. In addition, your marriage must have occurred prior to her 18 birthday.

What do I do to get help getting immigration papers for my husband so his two babies and I don't lose their dad?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
In order to assess immigration eligibilities, options and strategies, significantly more information would be needed about your husband and about you. There really is no substitute for consulting with an immigration attorney who, after learning all of the relevant facts, could provide answers to your question and, if feasible, could offer legal representation for the application process.
