There is no law prohibiting applying. It could be a factor in a denial, or they could issue the visa notwithstanding the I-130.

How do i speed up the process of recieving a visa to enter the country?

You could file for a K-3 visa which would allow your husband to come to the US to finish waiting for his I-130 to be approved.  However, these visas take about 5-6 moths to be approved and processed, so the I-130 might be approved first.  there is nothing you can do to speed up the process.

The student option is a good option. She can stay in the US in a stay authorized by the attorney general as long as she files the change of status before her I-94 expires.
