Can a resident alien be deported after pleading guilty to a d felony violent sex offender?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Even though the felon did not serve time in prison, and as such would not be treated as an aggravated felon, he has still committed a crime involving moral turpitude. The fact that he received probation does not negate the immigration consequences. As he pleaded to a felony and a felony always can be punishable by sentences of over one year, he is removable. If he was your boyfriend or husband living in the same residence with you and your daughter, he would also be considered to have committed crimes of domestic violence. He is thus deportable and given the circumstances that you describe, any relief petition that he makes before an immigration court would likely be denied in the exercise of the court's discretion.
