Can the police and ICE have access to the DMV fingerprints?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
It is not likely, but you might have to answer questions about it. What's important for you is having proof of your birth in the U.S.: if you have it, you can claim U.S. citizenship by birth. If you are a U.S. citizen by birth, then your attempt to enter the U.S. with another person's ID was a crime of false personation, but it does not deprive you of the right to enter the U.S. and live here (and, after 12 years, you cannot be prosecuted for it).

How easy is it to reschedule oath ceremony? Can we mention unavailable dates after interview?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
It should not be difficult, but I do not recommend doing that. Also, I do not really think that giving the dates when you are not available is going to help much, but you should of course mention them.

Do I have the right as a US Citizen to have my wife's citizenship revoked if she became pregnant with other man's child while we were married?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
If she didn't commit fraud in the naturalization process (material fraud, i.e., lied about something that would have made a difference in granting the claim), her citizenship cannot be revoked.  Certainly there is nothing you can do about it personally.  Only the US attorney can take action to revoke someone's citizenship, and since have a child out of wedlock is not even a crime in most jurisdictions, I predict the US attorney is not going to take any action.
