I am an American citizen, how long will it take for my spouse to get residence?

Answered by attorney Jennifer Maude Oltarsh

It depends on where you spouse is and if in the US, how your spouse entered. If you are confused about the process it may be advisable to hire a lawyer to help you through.

Will an open container ticket be a problem to get citizenship and if so, what should I do?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
USCIS has extensive discretion in determining whether a naturalization applicant lacks good moral character and is law-abiding. Eight violations over the last five years will not be treated lightly. While the specific offenses you mentioned may not automatically make you ineligible for naturalization, the USCIS is likely to use its discretion to determine you are ineligible. If you may be able to prove significant counter-balancing facts showing good moral character, it may be possible, though not likely, that the USCIS adjudicating officer would exercise discretion and approve your application. If you decide to apply, you will need to provide court-certified copies of all disposition documents. If your application were to be denied, that would not stop you from becoming eligible to apply again in the future. Unless naturalizing now is very important to you, for example in order to petition for a relative to get immigration benefits, or to qualify for a job that requires citizenship, it may be best to wait until five years have elapsed without any tickets/arrests.
