If your husband has a history of domestic abuse to either you or other familial numbers, he would be ineligible to sponsor you for permanent residence without obtaining a waiver. If he was imprisoned for other reasons, he would not be barred from petitioning for you, but U.S.C.I.S. may look at your case harder to see whether there is a bona fide relationship.
