Can I still be deported if I am a legal permanent resident since November 2013?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Sorry to hear about the complications in your relationship with your mother. Permanent Residents do not have obligations to live with a parent, even if the Permanent Resident attained his status through that parent. Although you did not ask for advice about this, I recommend that you and your mother seek professional assistance about resuscitating your relationship. That type of assistance could be from a clergy person, a social worker, a psychologist or psychiatrist with expertise in helping with that type of issue, and often that type of professional can help achieve success that may be impossible without a third party being involved.

I'm using the old edition 9/30/2015 N400 forms and I need to add additional information, where can I find the old version?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
The USCIS has asserted that, starting on August 8, 2016, it will accept only the March 26, 2016 edition of the Form N-400. Until then, the USCIS will continue to allow cases to be filed using the September 13, 2013 edition of the Form. Even for a case filed before August 8, 2016, it may be advantageous in the adjudication process to use the most recent form. Especially if you have concerns that there may be a complication or problem in using the new form, it would be wise for you to consult with an immigration attorney who, after learning all of the relevant details about your situation, could advise about eligibility and could offer legal representation in the process of applying to become a naturalized citizen - a process that often can be far more complex than it appears merely from reviewing the form and its instructions.

How can my boyfriend file for me if has served a one year sentence?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Although not clear from your question, I presume that your boyfriend is a U.S. citizen and that you already are in the U.S. after having entered lawfully and with inspection (such as with a temporary visa). If that is true, then after you become married you and your then-husband should be able to successfully pursue a marriage-based adjustment of status application process so that you may become a Lawful Permanent Resident (get a "Green Card"). This is true regardless of whether your husband may have committed a criminal offense for which he served a one year sentence. There really is no substitute for you and your boyfriend conferring with an immigration attorney who, after learning all of the relevant information about both of you, will be able to advise about immigration eligibilities, options and strategies, and should be able to offer legal representation in the often complex application process.
