I filled for the removal of the conditional green card through marriage. I did not receive a request for evidence .Is it a good sign

Answered by attorney David Troy Cox

Not necessarily.  At the interview, they will ask questions to determine whether you entered into your marriage in good faith.  As a result of the interview, they may request further evidence.

Am I eligible for a K1 fiance visa?

Reza Athari

If US consular officer found your previous applications to be fraudulent, you will need a fraud waiver with you K visa. Aside from that, the officer will scrutinize your K visa thoroughly.

Am I allowed to get married before I fix my parents' papers and will it not affecting them in anyway?

default-avatar
Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
You being married or single changes your ability to "fix papers" for your parents in only one way: as a part of the petition packet, you will have to submit an Affidavit of Support, a document showing that you have enough income to support your parents in the U.S. if they will not work. As immigrants, you parents will not have the right to receive welfare, SSI, food stamps, Medicaid, or public housing; asking the U.S. Government to give your parents green cards, you have to promise that you will support your parents so they would not need any public support. The income you have to show on the affidavit of support depends on the size of your family: if you are single, you need to earn more than $24,412 a year; if you are married (and your spouse does not earn any money or does not agree to take the obligation to support your parents) you need to earn $29,437 a year. If your income is less than these figures, you will have to find someone who would agree to become a co-sponsor for your parents.
