My husband has been here since 1999, what are the chances of him not having to leave the country to get legalized?

William H Nebeker
Answered by attorney William H Nebeker (Unclaimed Profile)

This is a very difficult and complex situation. I need to know the particulars of your husband's entry into the United States. This will determine the route to take in keeping him in the States without having him go out-of-country to start the legalization process. Did he enter with a Visa that later expired or did he enter without a Visa? Call or email to discuss this matter further, unfortunately this is a very, very delicate problem that must be addressed. There is hope, however, it will be a hard and difficult process, but that can be done.

If I marry my boyfriend can he apply for residency?

Brian D Lerner

Coming to the U.S. on a B2 Visa with the intent to marry is fraud. *K3 Petition* Since you are already married and your spouse is outside the U.S., it would be necessary to apply for the K-3 Visa. The particular visa is considerably faster than the Consulate Processing needed to bring your spouse in as a Lawful Permanent Resident. Here, we would apply for the K-3 Visa which would take about 6 months. After, your spouse is in the U.S., the Adjustment of Status package can be filed.

Can you be deported if you spouse dies?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
What is the immigration status of "fiance's brothers wife"? I assume her mother did not have legal status in the US. Also what was the immigration status of thedeceasedhusband? If he was a US citizen, she may file immigration petition by herself within two years after her USC husband died. On the other hand, if her daughter is a US citizen, she can also petition her mother.
