Following a divorce, a Conditional Resident may file an Application to Remove Conditions with a request to waive the usual requirement that both spouse file together. To be successful one must have a strong a persuasive set of documentary evidence showing that the couple lived together in a bona fide marriage notwithstanding its end in divorce. The USCIS adjudicates these applications on a case-by-case basis. While having children together and owning property together obviously are strong elements of evidence that the couple lived together in a bona fide marriage, those features are NOT required, and instead one may be successful by providing evidence that the couple "placed their financial lives together" by having and actually using joint bank accounts, joint credit cards, etc. Other useful evidence includes residential leases, utility bills, joint memberships of various types, jointly filed tax returns, certain types of photographs, and many other types of documentary evidence. There really is no substitute for engaging an immigration attorney who, after learning all of the relevant details about you and your marriage, would be able to advise you about the documentary evidence that the USCIS could be expected to deem sufficient to support an Application under your specific circumstances. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

The Office of the Foreign Student Advisor at the university your wife attends may be a good source of information about applying in the F2 nonimmigrant visa category, and should be able to explain the process as well as discuss advantages of that option, without the cost of engaging an immigration attorney.
