If I had a juvenile record and now I am 24 and already married to a US citizen, what are my chances of getting a green card?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
The immigration consequences of criminal matters is among the most complex areas of immigration law. Outcomes that were not "convictions" still may be treated as convictions by the USCIS; offenses that were misdemeanors still may be treated as felonies by the USCIS; sometimes a criminal case outcome/sentence can become modified long after the fact; etc. There really is no substitute for having an immigration attorney review court-certified copies of the disposition documents (charging document, plea, court finding, court sentence, compliance with court sentence, etc.) in order to provide a legal analysis and to identify the best course of action to take in order to achieve your immigration-related goals. And note, even if the criminal matter did not stand in the way of eligibility for a marriage-based immigration adjustment of status application, it would be necessary to provide court-certified copies of the disposition documents to the USCIS anyway. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

When applying for green card via marriage, is it necessary that both parties should have license at the same address?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
The immigration statutes and regulations do not require that a foreign national spouse and his/her U.S. citizen spouse have driver's licenses that show the same address, but the USCIS adjudicating officer may take a lack of identical addresses into consideration in assessing whether the couple is living together in a bona fide marriage. Generally, providing information/documents about limitations on getting a new driver's licenses, coupled with extensive documentation showing that the two spouses indeed are living together in a bona fide marriage, will be sufficient for success in a marriage-based adjustment of status case. The appropriate documents for a particular couple depend upon the circumstances, and it would be wise to engage an immigration attorney to learn the relevant information about you and your spouse in order to advise about appropriate documents.

Can I get legal status if my boyfriend has been arrested for aggravated assault and deadly weapon?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
There is no visa category by which a U.S. citizen may sponsor a girlfriend or boyfriend for immigration benefits, but if you were to become married to him, he may indeed be able to sponsor you to adjust status to become a Lawful Permanent Resident in the Immediate Relative visa category. This is true regardless of his past conviction and jailing for the two offenses you mentioned. Significantly more information is needed, however, in order to assess eligibility, and it would be wise for you and your boyfriend to consult with an immigration attorney.
