How do I remove my conditional status on my green card?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
If you have married him, he is not your "fiance". He is your husband. You should file divorce first. Once you receive your divorce judgment, and after the divorce effective date, you can file your own I-751 to remove the condition. You should hire an immigration lawyer with experience to handle your case.

Can one apply for residency or visa if they have an expired green card?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
If you had a ten year green card it will be much easier to renew. However, if you have been out of the US for that long, it is a very difficult thing to do. You need to show you had no intent to give up status even though you were out for more than a year. If your family are USC's, they can repetition for you. In the meantime you may be able to visit the US on a visitor visa.
