My brother is detained at Etowah county jail pending deportation, it's been a little over a year now. I think his charges were selling candle wax in

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
It sounds like your brother is charged with several aggravated felonies as defined by immigration law.  If that is the case, he is ineligible for a bond.  Because he is from Haiti, they cannot easily remove him because that country has been granted Temporary Protected Status because of the earthquake.  Your brother probably qualifies, but that that means he has to stay in detention until a country can be found to take him.  Your brother should get an attorney to represent him.

F-1 visa that expired on Sept.1,2014.Can I be denied a visa renewal with the circumstances below?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
By visa renewal, I will assume that you mean going outside the U. S. to renew your visa with the U. S. consulate or embassy. F-1 visas are discretionary with all consular posts. Having a spotty study record and not being able to support yourself without working may be seen as negatives in determining whether to renew your visa.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What is the fastest way to bring my parents and minor brother to the US if I am a citizen?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
If you are over 21 the fasted way is to file an I-130 and since your brother is a minor he can be included on their applications but some people do like to file a separate case just to be safe. Since you are a US citizen it will be a quick process so long as neither of your parents were ever in the US without authorization and do not have a criminal record. If you would like our assistance please call my office to set up a consultation. We charge $350 an hour but that would be credited to your case if you decide you want to hire us to assist your family coming over.
