If the USCIS did not deny your i-751, petition to remove condition, on the ground of marriage fraud, your second husband can file petition for you. On the other hand, if it was denied on marriage fraud, your second husband may encounter problem in his I-130 visa petition for you due to a special immigration law that bars immigrant visa for anyone who engaged in marriage fraud. You better retain immigration counsel to assist you.

First, the USCIS may soon reach the cap regarding H1B visa for this year. If it does before you file, the earliest you could get an H1B visa is October 2011. Post decision activity means a decision has been made on the case. For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations. Since you say she does not have a priority date yet, I would take that to mean her application was denied since if it was approved she would have an priority date. The filing of an immigration petition can affect a persons eligibility for an non-immigrant visa. Especially, not knowing why the petition was denied. I strongly advise you to speak to an experience immigration attorney regarding your case due to the possible H1B cap being reached and your fiance's denied petition.
