Can I get married if my I-751 has been denied?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
You can certainly get married; the question is whether you can get immigration benefits from the next marriage. I would need to see the I-751 Denial. If it was denied because of lack of cooperation of your ex spouse you may be able to self-petition if you are now divorced. A denial based on fraud will be a problem in any subsequent case so I would recommend you try to overcome that either with a self-petition if eligible or through a petition with your new husband but burden will be high to show not only new marriage is legitimate but to overcome any finding of fraud in previous marriage. I can advise better when I know the specific facts of your case and see the I-751 Denial. If you would like a consultation on the facts of your specific case feel free to contact me as indicated below. I do charge for consultations but whatever you pay for the consultation would then be a credit toward the fees for your case if we are retained for services after the consultation.

On M1 Visa- old school closed, application to transfer was done too late because of inaccurate information from the DSO- request denied

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Under the facts of your situation, SEVIS should certainly attempt to have your transfer go through as it appears that you did everything correctly and the fault was with the DSO of your old school. If it cannot be handled internally, you are entitled to file for reinstatement explaining the situation of how it was the fault of the DSO - Immigration’s person on campus. Yes but if you do not believe any fraud was committed then you should retain an attorney to present your side of the case.
