What do I do to petition my fiancee from the Philippines?

Reza Athari
Answered by attorney Reza Athari (Unclaimed Profile)
Immigration lawyer at Reza Athari & Associates, PLLC
You would need to file an I-129F as well as an I-134 for her with immigration. You would need to submit the required documents which are listed on the instructions of each form. The process can take anywhere from 6-12 months before she is able to have an interview at the embassy in Manila. After obtaining the visa, you will have 90 days to marry your fiancee once they enter the US. A lot of people apply on their own and I do not recommend that. One mistake you make and the process gets a lot longer. I suggest you hire an immigration attorney.

Could music production for a mixtape and for free, be classified as a volunteer act?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
U.S.C.I.S. will generally look to see whether individuals have been paid or compensated in other ways in deciding what is a volunteer activity. A hobby in which you are not being compensated would not be considered unauthorized employment. The advice that you have received that the volunteer activity should be regularly done by volunteers is probably advice on the more cautious side. The main concern would appear to be whether you are compensated for your activities. Can my husband become a green card holder after being deported?

default-avatar
Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
It depends on the facts of the case, but the difficulty is that he has been deported already and he has 3 DUI charges. This fact scenario will likely have the AMCON CONOFF refer him to a panel physician to determine if he has an alcohol addiction or dependency. If he does, then that is a ground of inadmissibility.
