What is the best way to file for a I-130 adjustment?

The risk is that she may be denied admission for her not being a bonafide no-immigrant. She should consider applying for a K-3 visa. However, in the event that she is admitted as a tourist, she would still be able to adjust her status in this country.

My boyfriend is married to a us citizen, however she does not want to file his paper what can we do

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
I imagine that that is a very good reason for the US citizen spouse to withhold filing paperwork on behalf of your boyfriend. There is nothing that you can do, and immigration law bars a US citizen from filing papers in a marriage case unless there is a bona fide marriage in which the parties intend to live in marital union. That does not appear to be your boyfriend's case. Answered by attorney Kevin L. Dixler

No. She needed to marry him before your 18th Birthday. There are other options for those who are the children of fiances of U.S. Citizens.
