If the letter of denial makes reference to your lack of lawful status, there is the possibility that you could begin incurring unlawful presence from the date of denial, May 8. As you are probably aware, remaining in the U. S. for 180 days would bring on a 3 year bar. If the denial makes no reference to lack of lawful status, it would arguably not be the trigger for unlawful presence. In the latter situation, you could possibly file a motion to reopen your case. Please note that the filing of a motion does not stop the incurrence of unlawful presence. In the event that you believe that U.S.C.I.S. mailed a request for evidence to the incorrect address, you can contact Its National Customer Service Center at 1-800-375-5283 and speak with a Service officer. If you do not incur the bar for unlawful presence, you are eligible to come back to the U. Good question.  If you would like to apply for permanent residency in the US while in the US, you may apply for adjustment of status, so long as you did not have a preconceived intent to live in the US at the time you were last admitted to the US.  If you would like to apply for permanent residency in the US on an immigrant visa while outside of the US, you may apply for an immigrant visa through consular processing in Montreal.  I'm not a fan of the K3 visa.  In your situation, it's important to consult with an immigration attorney to avoid a fraud determination from USCIS.  USCIS doesn't like it when spouses of US citizens come back and forth to the US as visitors.  USCIS often feels that anyone married to a US citizen is comng to immigrate to the US, and it can cause a real headache at the airport or the border crossing.
