Yes Alan the family law court may require your wife's ex-husband to sign a consent form that allows the child to travel and live permanently in the United States. I strongly advise you to get counsel to represent you from start to finish to process your Immigration case for your fiance, and your stepson. Counsel anywhere in the United States can represent you.

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Your friend appears to be too old to DACA, but he may be eligible under the new executive order. I suggest that he contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding his situation. (S)he would then be in a better position to analyze his case and advise him of his options.
