Hello. His visa does not control his authorized stay. It would be the I-94 that was issue to him (or online) that determined his dates he was legally here. If he overstayed 6 months and left, he will be barred for 3 years(10 years if he stayed overstayed a year).   What type of visa was it? When did you not process for the green card in the US?

Generally an adoption must be completed before a child reaches age 16 in order for the new adoptive relationship "count" in immigration applications. An exception to this rule exists when the child is adopted before he/she reaches age 18 while a sibling younger than age 16 also is adopted. In light of this, it would be wise to consult with an immigration attorney to explore other possible immigration-related eligibilities and options.
