Can I get married to my boyfriend to help him stay in the US?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
Legally you can marry him and file visa petition for him. USCIS may look at your case closer because you married an alien and filed visa petition for him too. Just document your marriage to prove it is not a shame marriage to help him get green card only.

Can someone get a visiting visa if they have been deported?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
Probably not, and certainly not for the period of ten years after the deportation. After that a waiver will be required.

Will my husband be able to get a visa?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
Your husband could be inadmissible for several reasons. First, he was unlawfully present in the US for more than 180 days when he was deported he would need a waiver for his visa to be issued. Also, he may need a I-212 "waiver" since if deported. Both of these require proving extreme hardship to you to be approved. Both of these are filed after he is denied his immigrant visa.
