He never showed up Since plaintiffs have failed to serve a notice of claim asserting claims for retaliation under Civil Service Law § 75-b [**17] and for negligence for contracting a staph infection, and since service of a proper, timely notice of claim is a prerequisite to commencement of a tort action against the DOE, moving merely to amend the complaint without first having sought and been granted leave to serve a late notice of claim asserting these additional claims, is futile. Accordingly, defendants' motion for summary judgment is granted, plaintiffs' motion to compel discovery and for leave to amend the complaint is denied and the action is dismissed in its entirety. I hired Mr. Borrelli and worked with him and another of his associates who both were unprofessional and made misrepresentations about the strength of my case in order to get me to sign. They dropped me without warning in the middle of my case and made threats to my well-being when I said I would tell others about their behavior. When you are already fighting the criminal actions of those you seek an attorney over, it's a horror to find a fraudster as your attorney as well. Spare yourself the compounded damages Mr. Borrelli cost me.
If you hire Mr. Borrelli expect to also need to retain at least two other attorneys. One you will need to verify the quality of his work and the other you will need to pursue Mr. Borrelli for Professional Misconduct. In my experience he has been the epitome of the cliche of the sleazy of the profession and will say anything to get you to sign and will then drop you without warning. Oh, you'll also need a fourth attorney to finish what Mr. Borrelli fails at on your behalf. Spare yourself the grief and find an honest attorney elsewhere. His personality and behavior are unpredictable and he turns on his own clients apparently depending on whether he was able to sleep the night before.
My experience with this attorney was dreadful. I would recommend looking elsewhere if trustworthiness is a significant characteristic for your next attorney to have. Will say anything to get your money and then provides subpar service bordering on fraud.
Michael Borrelli and his staff attorney Peter Famighetti did an excellent job representing me as a plaintiff in a defamation case. While we didn't win, I feel they did a great job preparing and arguing, and obtained concessions and an apology from the defamer, that helped me restore me reputation. Expensive, but worth it. I'd hire him again!
At any point and time if I had questions or need a representatives to be there at hearings or answer questions his associates were always there for me.
mislead from beginning , also , my case was switched from lawyer to lawyer to lawyer . felt that i wasn't given full attention and info was lost as each new lawyer took on the case .
