Answered by attorney John F. Brennan (Unclaimed Profile)
Estate Planning lawyer at Musilli Brennan Associates, PLLC
You should see an attorney, perhaps you will have to open a probate estate for your father in order to get letters of authority as his executor or personal representative which will allow you to retrieve the medical records.

What can I do about my father's estate, probate and misplace of will?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
You should speak with an attorney who practices in the area of probate in the area where your father resided at his time of death. Locating the original Will may not make a difference. An attorney experienced in probate can address the specific issues and options with you.

What type of power of attorney is needed to manage parent’s affairs with dementia?

Answered by attorney Bernard H. Greenberg
Estate Planning lawyer at Kokish & Goldmanis, P.C.
If your mother is already incapacitated, then she may not have the requisite capacity to sign powers of attorney. If she is able, she would want both a financial and a health care power of attorney. For further information, contact an attorney specializing in estate planning for elder clients.
