What do I have to sign to use power of attorney?

Answered by attorney Robert James Slotkin (Unclaimed Profile)
Estate Planning lawyer at Robert J. Slotkin
You don't have to do anything. If you want to sign their checks, just bring the POA to their bank. If you want to make trades on their broker accounts, just notify their broker and send him a copy. If your parents are competent, you ought to alert them what you are doing. Keep in mind you are a fiduciary and everything you do has to be for their benefit or you could wind up with legal problems.

Does property go to probate if it’s already in my name or just the other items stated in the will?

Answered by attorney Sabina Tomshinsky
Estate Planning lawyer at Home Town Law, P.A.
No, you do not have to do anything with property that is already in your name; you usually open a probate action to transfer property per the will or intestacy laws that is held in the decedent's name. Also, please be aware that the power of attorney expires upon the death of the principal.
