How do I get half of whatever money my family member left?

Answered by attorney Geoffrey N Germane (Unclaimed Profile)
Estate Planning lawyer at Kirton & McConkie A Professional Corporation
Well, it depends on your relation to the decedent. If you are an heir at law, and your sister was actually appointed by a court as the personal representative or special administrator, you should have received notice in the mail of those happenings. A personal representative has a legal duty to prepare an inventory of the estate of the decedent and all beneficiaries should get a copy of that. If the personal rep hasn't done this, you can file a petition in court demanding an inventory and/or requesting removal of the personal rep. An experienced attorney can assist you in determining your rights and best options.

What can I do if my mother died without a will and my siblings don't want to give me anything?

Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
Your brother and sister could not "put their names on" your mother's assets. This had to have been done by your mother, unless something fraudulent or illegal was done. You can check the situation as far as the home is concerned, by getting a copy of the deeds to the property. That will show who was on the title and whether or not your siblings were added, (and when). Any assets that were in your mother's name alone, would need to pass through probate, unless there were beneficiaries named. If your siblings have the money and there was no probate estate, then it is because the accounts were joint or your siblings were named as beneficiaries. If that is your situation, you are going to have a severe uphill battle trying to overturn that. You will need a good lawyer to even try.

What should I do if my trust that was left to me by my grandfather has been embezzled by two trustees and an attorney I hired?

Answered by attorney Michael Burton McFarland (Unclaimed Profile)
Estate Planning lawyer at Michael B. McFarland, PA
You will need an attorney to help you with this. Recommend you check with whoever you talk to early in the conversation to see if he or she knows the attorney you are going after, to see if it is a conflict of interest. At some point, the information is going to come out, so you should deal with it up front.
