Can power of attorney be stripped if it's being abused?

Answered by attorney Nathan James Wagner (Unclaimed Profile)
Estate Planning lawyer at The Law Office of Nathan Wagner
Yes, the lady can revoke the power of attorney at any time. She can also grant power of attorney to your girlfriend's dad, if she chooses. You should also talk to your local police or district attorney about whether the "friend" has violated any criminal laws against elder abuse by auctioning off her assets.

Is tangible personal property included in probate?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
The value of the property is usually included on the inventory and appraisal. It is generally estimated unless there is specific property that has been or should be appraised. Those items would usually be of value such as jewelry, coin collection, etc.

What should we do if the mother in law reneged on promises?

Answered by attorney Nathan James Wagner (Unclaimed Profile)

It's possible that you have a lawsuit against her for breach of contract. But it is hard to say for sure without knowing what promises she reneged on and what you had promised to do in return. If you have a breach of contract suit, a court could make your mother pay money to you to make up for the losses you suffered by trying to live up to your end of the bargain. Probably, the first thing you should do is find a less toxic living situation. If she is trying to run your wife off, you and your wife should live somewhere else.
