The wrinkle here is the mothers rights in the property..if papa has given all his property to one son that is his right and the other sons have no rights after he dies. However if mama retains rights in the property that is the question mama may have dower rights over real property so.

While a deed  trumps a Will (or lack of one), it must be delivered before death.  This generally means that it must be recorded before death.

Obviously you were not taking with a lawyer. I am not saying you need a trust, but to state that if you do not have over 3 million you do not need a trust is crazy. No one needs one, but almost all can benefit from one.
