This is actually a fairly complex question. I think you can do this, but not with a generic approach from a website. If you don't have a lawyer helping you with administration of the estate, I recommend getting one to help you work through this mortgage issue.

No, the property is still yours. However, he can claim an equitable interest (similar to a lien) on the house since he added value by paying a portion of the mortgage principal. He would have an uphill battle though, since you would presumably claim that it was a gift. BTW, this also applies to capital improvements to the home that he pays for (what he contributed that would enhance the value of the home).

I have just found a last will and testament that says I am the executrix of my parent estate is this all I need for a lawyer?

Your question is incomplete what do you want to do with a lawyer? If your parents had assets that need to go through probate (accounts in their name without beneficiaries listed, real estate, etc.) and other beneficiaries (do you have siblings? )all relevant information on both of those would be needed.
