I think you answered your own question: You are not willing to pay-to-play. That means you are willing to accept things the way they are. If the present scheme does not include you, then you can't do worse than that if the contestants prevail. Who knows, you might even get a windfall.

I was served a subpeona for a case that there was no court case on for that date. Can that be done?

Sounds like to me who served the subpoena was a day late and a dollar short, if it doesn't give you a date, place and time to appear.

Is it a legal offense to not have a will probated, when an executor has been appointed over an estate and other people are named in the will?

It could be, especially if you swear there is no will and there is one. In the probate case, if you have a copy of a will, you can submit that to the court for it to determine whether there is a valid will. Talk with an attorney about the best way to proceed.
