Do my parents own the property they bought from the previous owner that died without changing his last will?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
If he deeded the properties to your parents, end of story. The will is irrelevant and your parents own the properties. The fact that he never changed his will is not your parent's problem.

Is an agreement to purchase real estate a legal and binding document?

Answered by attorney Jayne L. Sebby (Unclaimed Profile)
Estate Planning lawyer at Jayne L. Sebby
Yes, it usually is when it is in writing. However, each party can still get out of the actual land purchase by paying some sort of penalty. If you back out, you will lose your earnest money.

If my mother had a bank account and property, do her children get an equal share or one gets everything?

Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
Did she put the bank account and property in joint ownership? Then one gets everything. Did she have a will? Will controls. No will? Then spouse and children take. Is there a lot of property at stake? Hire a lawyer and find out what your rights are.
