That's not a good idea. One of the only benefits of a trust is that it can be effective to transfer property in two states. Your question makes me think you need a lawyer's assistance with your estate planning.

She is not wrong to cash it, and then distribute as the estate was distributed. However, it is going to be difficult. If it proves to be impossible, return the check, wait for it to become unclaimed property, and claim it from the Division of State Lands.

Assuming his injury occurred while he was married to you, and assuming the land was purchased while he was married to you, the answer to that question would be yes on both accounts. If not, the answer would be no with respect to whatever interest accrued prior to marriage.
