You have certain elections, spousal rights including a homestead allowance, an exempt property allowance and an spousal allowance under Michigan Probate law if the house were solely in his name and subject to the probate court's jurisdiction. You may have a dower interest in the property. Your husband's estate plan could provide a life estate for you.

If you want to add her, you have to comply with the bank's rules. You do not HAVE to add her. If you become incapacitated, she can use the power of attorney to access your accounts. If you pass away, she can get it through the will or a small estate affidavit. It is certainly more convenient to add her.

It sounds like there should have been a probate. I would start by calling the probate court in the town where your mom lived. A will is supposed to be filed with the probate court 30 days after death whether or not a probate was opened. If the will was filed, the probate court will have it and you will be able to get a copy.
