How do I attain a copy of my mother's will?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
If the Will was lodged young o Tao. A copy from the courthouse. Also I'd the Will was probated a copy may be attached to the initial petition. As far as what is required, i.e., probate, it is difficult to say without knowing how the assets were titled at the time of your mother's death. Best of luck to you. Seek out legal Counsel if you are unsure.

What can I do about my father's estate, probate and misplace of will?

Randy M Lish
Answered by attorney Randy M Lish (Unclaimed Profile)
Estate Planning lawyer at Randy M. Lish, Attorney at Law
If you cannot find the original will, and nobody has a copy, the only thing you can do is go through an intestate probate. The court will not create a will based on what somebody believes it said. However, once a personal representative is appointed, that person can require that anyone with a copy of the will produce it so it can then be probated.

If the insurance company has the forms, that will help. If not, then you can have a lawyer prepare the disclaimers.
