I do not want to make a will; I want to give everything I own to my children before I die, how do I do that?

You can gift up to $14,000 per person each year. You can just give to them. No special process unless worth more than $14,000 in any year to any one person, then you just need to file a Gift Tax REturn.

How can I be a temporary guardian to my minor daughter for her to get the death benefits?

Answered by attorney James Bloomfield Oberholtzer
Estate Planning lawyer at James Oberholtzer, Chartered
A temporary guardianship can cost $2,000 to $3,000 to set up and annual costs of about the same to prepare reports to the court. Usually a trust would be much less expensive. You could ask the insurance company if it will release the funds to a trust for the benefit of your daughter.

If my dad passed away and I was the only child and he wasn’t married would I get all of his belongings?

Answered by attorney James T Weiner (Unclaimed Profile)
Estate Planning lawyer at James T. Weiner, P.C.
If your dad passed without a will, unmarried and with no other siblings in Michigan you are presumptively his only heir. If your uncle took anything from his estate yes you can get it back. You will need to file a probate action to become the estate's personal representative and then be able to sue your uncle to get it back.
