Does my step daughter have a claim to any of my estate if I do not name her in my will?

Answered by attorney Christine James

It is hard to say without seeing your husband's will and yours. The short answer is, anything left to you, you are free to leave to whomever you choose.

If a person whom has POA dies before the person whom he has POA, does the POA go to the executor of the deceased estate to appoint another?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
Your question is hard to understand. The principal is the person who appoints and agent under a POA. If the principal dies, the POA is no longer valid and the estate would be administered through the will or trust. If the agent dies, the principal can, if they have capacity, simple prepare a new power of attorney form designating a new agent. I hope this helps.

Can you use Medicaid to cover nursing home costs if you never paid into it?

Medical as it is known in California is available to all who qualify and it sounds like your father initially qualified. True your mother won't lose during the time she is living in it, but medical acquires a lien on the property at your mother's death, and the heirs will have to satisfy that lien before receiving any share of the proceeds from the sale of the home.
