It sounds like that would be the distribution. Given the importance of this matter, however, I would have an attorney review all of the circumstances, before you proceed. You may need to have a probate estate opened for your brother and/or his wife. If this passes through the wife's estate, then you would not be HER heirs.

Is an estate open? If so, has there been a publication of a notice to creditors? If so, creditors have 4 months to bring a claim against the estate. If they fail to do so, then their claim is barred. There is no reason to keep an estate open for two years. P.S. If there is no estate, then your sister is not the Personal Representative. It is unclear how she would have control, if that were the case. She is obviously not represented by an attorney. She probably should be.

Can I just destroy an old will and make it invalid?

Under Nevada law absent a provision in your decree the Will as to your ex-husband is invalid. You can destroy it to revoke it. I usually suggest my clients destroy it, and write canceled/revoked on it, rip in a few pieces and save to show it was revoked. Also notify the attorney who drafted it, so it is clear that it was revoked. Best to make a Will to handle your affairs and state that all prior Wills are revoked.
